With the previous U.S. tariffs having been struck down by the highest court in the land, some Nintendo customers want their refunds.
The class-action lawsuit, filed in Washington state by two Nintendo customers, claims Nintendo intends to financially benefit by receiving tariff refunds and raising prices of its products.
According to the lawsuit reported by Game File, this double-dip is a violation of Washington’s consumer protection law.
“Unless restrained by this Court, Nintendo stands to recover the same tariff payments twice – once from consumers through higher prices and again from the federal government through tariff refunds, including interest paid by the government on those funds,” reads the lawsuit.
The class-action lawsuit covers consumers in America who purchased tariff-affected Nintendo products between February 1, 2025 and February 24, 2026. Nintendo hasn’t yet commented on the lawsuit.
Earlier this year, the U.S. Supreme Court struck down U.S. president Donald Trump’s previous global tariffs due to the mechanism used to enact them. As a result, Nintendo and over 1,000 other companies sued the government in the hopes of getting tariff refunds.
Those lawsuits are on pause while the U.S. government creates a way to issue those refunds.
